Terms of Service
Last updated 28 October 2026
These Terms govern your use of KitchenComps (kitchencomps.com,
the web app at app.kitchencomps.com, the
Chrome extension, and any related API). By creating an account or using the service you
agree to them. If you don't agree, don't use the service.
"KitchenComps," "we," "our" refers to the operator of this
service. "You" means the person or business using it.
Plain English summary. You get a tool that watches public listings and
flags under-market deals. You pay for Pro features. You don't use the service to break
other sites' rules, you don't resell our data, we don't guarantee any specific
deal will pay off, and either of us can walk away.
1. Your account
- You must be 18+ and legally able to enter a contract.
- You're responsible for your login credentials and anything that happens under your account.
- Share account access with teammates by using team seats; don't share passwords.
- Notify us immediately if you suspect unauthorized access.
2. Acceptable use
Don't use KitchenComps to:
- Resell, scrape, or redistribute our aggregated price data as your own product.
- Attempt to access other customers' data or circumvent our security controls.
- Submit requests at a volume intended to degrade service for others (DOS, brute force, "stress tests").
- Reverse-engineer the service except to the extent allowed by law.
- Use the browser extension or API in ways that violate the terms of the sites it interacts with (eBay, GovDeals, etc.).
- Harass, defame, or send spam through our delivery channels (email, Slack webhook, etc.).
We may suspend accounts that materially violate these rules while we investigate.
3. The service "as is"
KitchenComps aggregates listings from third-party sources and estimates fair-market medians.
Those estimates are informational. We make no promise that any particular alert will result
in a profitable purchase, that a listing will still be available when you click it, or that
a seller's claims about an item are accurate. Do your own diligence before transacting.
The service is provided as is without warranties of any kind — express or
implied, including merchantability, fitness for a particular purpose, non-infringement, or
uninterrupted availability.
4. Billing & subscriptions
Beta period
New accounts receive a 30-day free beta with full Pro features. At the end of the beta,
accounts without an active paid subscription are moved to the Free tier (3 watches, email
delivery only). No card is required for the beta.
Pro and Dealer plans
- Pricing is listed at kitchencomps.com/#pricing.
- Monthly plans renew monthly; annual plans renew yearly, in each case automatically.
- Payments are processed by Stripe. We never see or store your full card number.
- You can cancel anytime from Settings → Billing. Cancellation ends renewal; access continues through the paid period you've already covered.
- Fees already paid are non-refundable except where required by law.
- We may change prices with 30 days' notice to the email on file. Changes don't affect the current billing period.
- Applicable taxes may be added at checkout.
Failed payments
If a renewal payment fails, we'll flag your account as past due. If payment isn't
resolved after a reasonable period, we may downgrade or suspend Pro features.
5. Data & intellectual property
- Your data (watches, alerts, settings, webhooks you configure, uploaded inventory): you own it; you grant us a limited license to host and process it so we can provide the service.
- Public market data (listings and derived price indexes): we aggregate publicly accessible information from third-party sources. We don't grant you a license to redistribute this data as a standalone product.
- Our software, UI, and brand (KitchenComps name, logo, screens, code): we own it. You get a limited, revocable license to use it to the extent needed for your use of the service.
- You may export your own data at any time from Settings or the public API (Pro).
6. Third-party sources
KitchenComps surfaces listings from third-party marketplaces including eBay, GovDeals,
Public Surplus, Kitchen Equipment Trader, and AllSurplus. Those sites have their own terms
that govern your interactions with them — including when you click through from an alert
to a listing. We are not responsible for third-party content, availability, pricing, or
seller behavior.
7. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special, consequential, or punitive damages (lost profits, lost opportunities, data loss, downtime), even if advised of the possibility.
- Our total liability for any claim arising out of these Terms is capped at the amount you paid us in the 12 months immediately preceding the event giving rise to the claim.
- Nothing in these Terms limits liability for fraud, willful misconduct, or anything else that can't legally be limited.
8. Indemnification
You agree to indemnify and hold KitchenComps harmless from third-party claims arising from
your misuse of the service, your violation of these Terms, or your violation of a
third-party right (including intellectual property or privacy).
9. Termination
- You can terminate at any time by canceling your subscription and deleting your account.
- We may terminate or suspend accounts that violate these Terms, with notice when practical.
- On termination, your right to use the service ends; your data may be deleted after a short retention window.
10. Changes to these Terms
We may update these Terms as the service evolves. If a change is material, we'll notify
you by email or in-app banner at least 15 days before it takes effect. Continued use after
the effective date is acceptance of the updated Terms.
11. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict
of laws rules. Any dispute will be brought in the state or federal courts located in New
Castle County, Delaware, and both parties consent to the personal jurisdiction of those
courts. The parties waive any right to a jury trial.
12. Miscellaneous
- If any provision of these Terms is unenforceable, the rest stays in effect.
- Our failure to enforce a provision isn't a waiver of future enforcement.
- You can't assign these Terms without our consent; we can assign to a successor in a merger, acquisition, or asset sale.
- These Terms, plus the Privacy Policy, are the entire agreement between us about the service.
